A First Time for Everything

For the first time in New Jersey legal history, the Appellate Division of the Superior Court has applied the U.S. Constitution’s 2nd Amendment Right to “Keep and Bear Arms” to order the return of an individual’s seized firearms and gun license. [More] 
I suppose we should be appreciative, but all I can think of is it took 'em long enough, and how far away that "shall not be infringed" mandate still is.

Saving Face

Yes, Shaneen Allen not doing jail time is good news for us all and wonderful news for her and her children. [More]

The prosecutor had to realize this was a political loser, but I guess they couldn't just let her go with an apology for bothering her. I can't help but wonder if a less sympathetic defendant would have faced a different outcome.

In a rational world, everyone who held -- and is still holding, with the mandated appearances -- this woman hostage for exercising her right would be doing time themselves.

I've asked her attorney, Evan Nappen, if she'll be a prohibited person when the smoke clears.  My guess is "No," but this is New Jersey. I'll update this if/when I get a response.

Another Outrage in New Jersey

I was actually approached on this in late January by a friend of the defendant who'd read some of my postings on Brian Aitken.  Here is what I replied back:
Step One: Get immediately in touch with Evan Nappen, copied on this email. He is an authority on NJ gun laws and the best person to advise on how to proceed and steer Keith to the right atty. Whether on not any gun rights groups may decide to get involved to help with defense is something I can't say at this time. 

Step Two: Say nothing to anyone on this without advice of counsel.

Yes, stuff goes on behind the scenes that never makes it to the front until such time as competent counsel deems it appropriate. I'm delighted to see this development. Mr. Pantaleon could not be in better hands.


Help is needed -- in spreading the word and with the defense. That's where you come in.

WoG regulars know I have concerns about Cruz.  This isn't one of them. He played a part in something larger. I think everyone understands that.

Everyone except the "reporters' at The Trace, who seem to be obsessed with NRA. And no wonder -- they're the finest propagandists Bloomberg money can buy.

That said, Evan Nappen points to an important consideration the hit piece raises about caveats and what they have enabled.

You don't need to give away the farm to claim your cow. Or at least you shouldn't have to.

"The Defective Bill is Absurd"

Handgun sales and purchases by New Jersey Retail Dealers are going to virtually end after November 2009. This is because the New Jersey legislature hurriedly passed the so-called “One Gun a Month” bill (A339), which was known to be seriously flawed. The defective bill is absurd, as it address a non-existent problem. No self-respecting gun trafficker would obtain their handguns by first applying for New Jersey Handguns Permits, paying over $50 in fees, and insuring that any handgun he sells on the street was papered to him! Notwithstanding just how idiotic the law is, it awaits the Governor Corzine’s signature and there is no reason to believe he will veto it. [More]

Real Talk in Jersey

A televised debate between noted gun rights attorney/author Evan Nappen and the President of CeaseFire NJ is scheduled to air on Sunday, July 13 at 12:30p.m. on WWOR-TV (Channel 9). The name of the program is Real Talk.
If you live in the area, you might weant to watch or record this. I looked at the My9 website, but couldn't find more detailed info and didn't have the incentive or patience to explore it. If you do see it, let us know how it turned out, and if a link to the debate is ever posted, please share it.
