In the liberty lovin' state of Texas you face arrest and jail for virtually any 'offense'. We've had folks hauled off for threats to the public safety such as failure to use a seatbelt.
And we still have numerous offenses that law provides an 'affirmative defense' for; in effect decreeing you're guilty unless you can prove otherwise.
