Well, the RIAA claims that copyright infringement of a single song damages them to the tune of hundreds of thousands of dollars (despite vending the same song on iTunes for $0.99), so I'd say you're good to sue for at least a million + court costs and attorney's fees...
C'mon David, you didn't expect them to abide by the same rules they set up for us, did you? /sarc

They seem to think they are above the laws the rest of us "little people" have to follow. I would at least, send them a certified take down letter and be sure to post it here! :)
I would never accuse them of understanding the word "infringe".
