So Much for "Home Rule"

Philadelphia officials cannot enact gun laws tougher than Pennsylvania's law, a state appeals court ruled Friday in throwing out city ordinances that included limiting gun purchases to one a month and banning assault weapons.
Good. And just in time for the race war.

But let's not forget that preemption carries its own dangers.

Does this ruling now negate Philly's ordinance against open carry sans permit? After all, state law requires no permit for open carry.

No, open carry is Philly is codified in State law - 18 Pa.C.S. § 6108.

Preemption of the State over the Local...

Of the Federal over the State...

Of the UN/WTO/etc-to-come over the Federal...

May be good here in this case, but just be careful what you wish for.

I believe the individual preempts ALL.

Preemption is nothing to be afraid of so long as the preemption is of laws that are more restrictive of individual rights...
