Republican 'Justice'

The dissenters were Republican justices Stephen Markman and Robert Young Junior. [More]
Here's the opinion.

The officers were trying to "secure" the home while they waited on a warrant. Fine. Stand out on the sidewalk until the warrant shows up.

I'm glad the MSC slapped these assholes. I'm wondering about those two Republicans though, do they not believe in the Constitution? Would they just throw their doors open to the police for any reason?

Markman and Young may have correctly interpreted legislative intent. The other five seem to be grasping at straws when they say legislative intent wasn't clear, so they get to ignore it.

OTOH, who gave the legislators the authority to overthrow the Fourth Amendment?

Simple solution here, charge the two thugs with assault, battery, armed home invasion and kidnapping.

Then maybe they'll learn to secure the premises from outside while they await a no probable cause warrant from one of the crooked local judges.

Good ole law and order Republicans. It makes you wonder what other kinds of "forced entry" they would deem illegal to resist.

Seems that most neocons haven't seen any abuse by law enforcement they have a problem with. After all, in most incidences of abuse, the LEO(s) involved were "following procedure."

Yeah - no problem with abuse - until it happens to them.
