We're the Only Ones Assumptive Enough

Body camera footage released by the Aurora Police Department of the fatal shooting of Richard “Gary” Black. [Watch]
So failure to immediately obey screamed commands, which could be attributed to a number of reasons including confusion, shock, hearing impairment, etc., should be enough...?

I'm hearing impaired to start with. I was involved in a situation some years ago that involved having to display my sidearm to prevent an attack. Display only - it never even left the holster. I can tell you, the symptoms described by others (tunnel vision, even worse hearing impairment) are quite real. In a stressful situation, it's quite possible he never heard the police.
