Behavior Modification

Although a guidance document does not change the relevant legal standard, the issuance of such a document can affect behavior. Individuals who learn they are closer to the relevant legal line than they had realized might be encouraged to comply with the relevant legal requirements, or they may opt to stop selling guns. In this way, a guidance document may help to discourage behavior the government wishes to control but which may lie beyond the government’s legal reach. [More]

CHILLING EFFECT

Constitutional scholar that he is, Obama knows full well the sheep dip he spewed, crocodile tears ala mode, has a chilling effect. In legalese, the discouragement of any legitimate exercise of natural or legal rights is as forbidden as outright bans on gun ownership. The most lawful and least law knowing are likely to curtail the selling of even one firearm for fear of retribution. All of which will have zero effect on crime, but chills the market for granny who wants to sell grand-dad's old Colt. Politicians and rust are the two greatest enemies of gun collectors.
