I don’t believe I’ve ever seen a lawyer claim in a legal filing that such-and-such was “in violation of the Declaration of Independence,” and would be wary of any one who did.

One can appeal to the spirit of its founding principles, but one cannot appeal to it as a controlling legal authority.
