McDaniel Brief Has Hidden Bomb

It confers nothing, and someone playing at your level ought to know that.

Look, we appreciate your filing on behalf of Heller--but don't let this twisted understanding make its way into your final brief--it can do more harm than good. Our opponents will point to it as an ingress for what they're calling for now that they perceive the wind may blow against them--repeal.

I'd love to see a repeal movement. Talk about stirring up a hornet's nest!

A great many gun owners live in gun friendly areas and/or are only concerned about their limited firearms. However, they do feel that the 2A means something. Attempt to repeal it and they'll come out of hiding.

My letter to the Arkansas Attorney General

Dear Mr. McDaniel;

I respect and appreciate your support of the human rights of the citizens of Arkansas and the United States which you have demonstrated in your brief to the U.S. Supreme Court re: DC vs Heller. I would, however, like to suggest that you make one alteration in focus when you construct your brief.

In your press release, you stated “I believe the Second Amendment confers a Constitutional right to bear arms on individuals, not just on militia members." I respectfully submit that the Right to Keep and Bear Arms is not actually CONFERRED by the Constitution, but is rather a natural human right, PROTECTED FROM INFRINGEMENT by the Constitution. This is a very important distinction.

Before the Constitution was even dreamed of , men have had the human right to bear arms in national, state, community, and self defense. From the paleolithic dawn of history, man has had the right to whatever stick, rock, spear, arrow, or axe he deemed necessary for his survival. Human nature has not changed, and neither has the natural, God-given right to use whatever arms are required for the situation at hand. Yesterday we used flint, today we have guns. Same principles, same rights, different day.

When you write your supporting brief, please make reference to the Rights of Man as the governing principle behind the Constitution and the Second Amendment. I strongly believe that these arguments are much more powerful than a simple nod to a 18th Century document in the US Archives.
