The article at the second link, as well as others I have read on the subject, indicate that MJ use is a disqualification for BUYING a firearm, but I’m not aware of it being a disqualification for OWNING one you may already have, or being given one as a legitimate gift. I don’t believe I’ve heard that it’s a bar to a private sale, either. Am I wrong?

Nikki Fried, Florida's Agriculture Commissioner, and the politician in charge of Florida's concealed carry program, has both a concealed carry permit and a medical marijuana card.

You're supposed to answer truthfully and honestly on Form 4473. I personally know of a guy that has a medicinal pot card, and has purchased new firearms after getting and using his card. In Kommiecticut anyway, there is no cross-check.

Here's the scoop from the ATF:

"Identify Prohibited Persons

The Gun Control Act (GCA), codified at 18 U.S.C. § 922(g), makes it unlawful for certain categories of persons to ship, transport, receive, or possess firearms or ammunition, to include any person:

convicted in any court of a crime punishable by imprisonment for a term exceeding one year;

who is a fugitive from justice;

who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act, codified at 21 U.S.C. § 802);

who has been adjudicated as a mental defective or has been committed to any mental institution;

who is an illegal alien;

who has been discharged from the Armed Forces under dishonorable conditions;

who has renounced his or her United States citizenship;

who is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner; or

who has been convicted of a misdemeanor crime of domestic violence.

The GCA at 18 U.S.C. § 922(n) also makes it unlawful for any person under indictment for a crime punishable by imprisonment for a term exceeding one year to ship, transport, or receive firearms or ammunition.

Further, the GCA at 18 U.S.C. § 922(d) makes it unlawful to sell or otherwise dispose of firearms or ammunition to any person who is prohibited from shipping, transporting, receiving, or possessing firearms or ammunition."

Note that there is no mention of form 4473 much less how the questions were answered. At the present time I know of no place where anyone is cross checking marijuana cards and concealed carry permits or FOID cards. Yet. However, it is pretty plain that the possibility exists that FedGov might order just such cross checking in the future. Florida's Agriculture Commissioner Nikki Fried, who's department runs Florida's concealed carry program, says it will not happen on her watch and she is one of the folks, by her own admission, who has something to lose if that were to happen.

But what if she was made an offer she couldn't refuse?
