If a service member refuses an administrative reprimand or NJP, they could demand to be tried at court-martial... If service members are tried and convicted by a court-martial and the punishment triggers an appellate review, the case is brought to the respective branch’s Court of Criminal Appeals, such as the Army Court of Criminal Appeals or the Navy-Marine Court of Criminal Appeals. If they are tried and convicted in the appeals court, the case reaches the U.S. Court of Appeals for the Armed Forces. If a service member is convicted in this court, they would likely receive a dishonorable discharge, a bad-conduct discharge, or, in the case of an officer, a dismissal.
