The City Has No Say

We talked about Steve Lynes' letter in The Lompoc Record challenging the militarization of police and the procurement of suppressors for their rifles.

He wrote to his local representatives, including the mayor and councilmembers. One, Bob Lingl, has seen fit to respond to date. Here's the position he staked out:

If I recall the article correctly, it is not the city the is buying these items for the police department but instead a private, civilian foundation. I might agree with you if it were the city buying them, but if a private foundation wants to buy them I don't see where the city should have any say.

Really? Elected representatives of the people are properly out of the loop on what's deployed against their constituents? If a private entity wants to do--whatever--for the police, the city will have no say?

I found a website that lists all the escort services in Lompoc. So I guess if I want to pay to send a lap dancer over to entertain Chief Dabney--assuming he's OK with it-- that'll be just fine with the City Fathers?

According to the latest proposals contained in the National Policy on Small Arms and Light Weapons, no one will be allowed to own an AK-47 rifle, a G3 or “any automatic or semi-automatic self-loading military assault rifle of any other calibre”.

Many years ago, I used to be a shift supervisor in a medical plastics department under strict FDA cGMP compliance rules--we made IV tubing and the like, and had to do our compounding and extrusion operations in a "clean room" environment. This necessitated suiting up in special cover-alls, head gear and footwear before entering the controlled environment--including reversing the process in a controlled staging area before leaving.

We were expected to be on time and ready to relieve the previous shift when the bell rang--and the clock started.

Of course, we were only mere productive citizens paying for all this government largesse--it's not like we were "Only Ones" or anything.

I wonder if the judge gets paid to put his robes on and take them off...?

Using Poor Judgment at UNC

Some of the readers here have received a response from Holden Thorp, the UNC Chancellor who canned a gun-owning professor for stating in an email he was prepared to defend himself in response to political enemies posting hateful fliers with his home address.

Funny. Dr. Thorp didn't reply to me.

Anyway, here's his canned answer:

Thank you for your note. I’m glad you took the time to write because it gives us the opportunity to ensure that you have the complete facts.

It is not appropriate for a faculty adviser to threaten a student with a gun—-whether he’s kidding or not. This issue is not about the right to bear arms. It’s about a faculty adviser using poor judgment. And I agree with you. The people who put up the fliers also used poor judgment, but we don’t know who did that.

I am committed to protecting Carolina's tradition of free speech. Within three days, I had helped YWC identify three new advisers, each of whom has already agreed to work with YWC so that it retains its status as a recognized student organization. I also pledged to the group that we would reimburse their expenses to bring a new speaker to campus in October. The YWC has invited Bay Buchanan, former U.S. treasurer under President Ronald Reagan.

The chief of the Morningside Police Department in Prince George's County was fired this morning following media reports that he was under investigation for selling two weapons...

They said authorities were investigating a complaint that Eichelberger sold two weapons -- a handgun and a shotgun -- out of the trunk of his police car for $600. Authorities were investigating whether the alleged sales violated state gun sales laws. [More]

Per Morningside ordinance:

Section 9-106.

Discharging or possessing firearms or other dangerous weapons

No person other than an officer in line of duty, or a person in the necessary defense of life or property, shall discharge any firearm of any kind, or any air rifle, within the limits of the Town. No person, other than a law enforcement officer, shall have in his or her possession while on the streets of the Town, any revolver, pistol, blackjack, brass knuckles, or other dangerous weapon except guns or archery equipment for game hunting or target practice which shall be no ammunition in either the barrel or magazine or arrows nocked.

Well, I don't see where it says the guns were loaded, but selling out of a trunk would indicate "possession while on the streets of the Town." But that's not the chief's rap.

And perhaps there's another "out" for the chief under state law. Per NRA-ILA's "Firearms Laws for Maryland":

Maryland does not regulate the sale of rifles or shotguns and no permit is required to purchase a rifle or shotgun.

Maryland does regulate the sale, transfer, rent and possession of regulated firearms, which consist of handguns and assault weapons. A person who is not a regulated firearms dealer may not sell, rent, transfer, or purchase any regulated firearm without going through a regulated firearms dealer. Alternatively, the prospective seller/transferor and prospective buyer/transferee may complete the transaction through a designated law enforcement agency.

Well there you have it--it seems the Chief "Only One" designated himself.

Arnold in his expedition to Quebec, at the Storm of which under General Montgomery, he was made prisoner.

I remember when I was first starting out WarOnGuns, and put a bunch of "established" gun bloggers on my list who, it turned out, would not give me the time of day. I thought that was pretty snotty and promised myself I would never be like that.

Better that one cooperates with the police when one is the object of their undivided attention. Like it or not, they are in charge on the street.

This incident is only "the second in five weeks involving a Grand Junction Police Department officer accused of criminal activity while off duty."

What if an FFL was not acting in his capacity as a federal licensee to manufacture for personal use, or to transfer firearms strictly within a state? Or what if a person so engaged was not a federal licensee at all?

Today's Gun Rights Examiner column covers the lawsuit filed against the feds by SAF and MSSA, and includes a copy of the complaint.

I know some have dismissed this strategy. I also know that this is a good case in terms of being consistent with founding intent, but admit seeing unconstitutional tyranny prevail in federal courts is an outrageous possibility. Still, there's a very important fundamental object lesson to be learned here if that happens. Anyone who dismisses it is no one I care to follow.

Yeah, you'll see some results trending in a positive direction when peaceable people can protect themselves. But I wouldn't expect any miracles, as a good part of the violence is taking place among a population that won't see its prohibited status affected one way or another. And McDonald won't do a thing as far as legalized carry is concerned:

At issue are Chicago’s laws (1) banning the registration of handguns, thus effecting a broad handgun ban; (2) requiring that guns be registered prior to their acquisition by Chicago residents, which is not always feasible; (3) mandating that guns be re-registered on an annual basis, including the payment of what amounts to an annual tax on the exercise of Second Amendment rights; and (4) rendering any gun permanently nonregisterable if its registration lapses.
