A Bad Gun Show Experience

I received the following email. I share it here in the hopes of enlightening us all a bit:
Dear David,

Just a quick question, I hope you can help educate me.

My wife and I went to a gun show today in Austin, TX. I wasn't planning on buying anything big so I only took $120 with me. Then I found a particular model shotgun I've been looking for but unable to find, price $450. My wife (bless her heart) said we could put it on her credit card.

I told the dealer we wanted to purchase it, so he asked for ID. I gave him my driver's license, and my wife took out her credit card. He said, "Sorry, the person who purchases the gun needs to be the one to fill out the paperwork." Fine, my wife said she'd do it. Dealer then said, "No, I can't sell you the gun now because he [meaning me] already said the gun was for him." I actually didn't say "I" wanted
to purchase it, I said "we"; it just so happens that I handed him my driver's license instead of my wife's. I wouldn't say the dealer was being a complete dick, but he was... dick-ish. We just walked away.

I've purchased other guns in the past using my wife's credit card -- one time at a gun show where she filled out the NICS paperwork, another time at a local store where I did the paperwork but they took her card without saying a word. We've been married for 8 years, live at the same address, have the same last names, shoot together... we were simply dumbfounded. I don't have a single credit card in my name, swore off the damn evil things 5 years ago and haven't needed one since (until today, I guess...). The dealer made no effort to try to find a way to accommodate us. He clearly didn't want our business, so he didn't get it.

I understand that the first line on form 4473 is “I am the buyer of this firearm” and the purchaser must answer honestly yes or no in ink, in his or her own handwriting. Our stated intention was to purchase the shotgun for our home. Everything in our home is community property, as any divorce court would maintain, so if my wife answered "yes" on Line 1 she would have been telling the truth. We were not trying to pull one over on the dealer or circumvent the law.

I can also understand that dealers have to cover themselves from the feds who want to put them out of business for typos and punctuation errors on their FFL forms and all.. but was what we were doing in any way improper or illegal?

In the end, this whole episode left a really bad taste in our mouths, to the point where we've agreed never to buy at a gun show again and support our local dealers instead.

I've never tried to buy a gun this way, so I put it out to you for comment.

My response:
Unfortunately, the ATF has become so aggressive on "straw purchasers" that dealers are afraid to do anything that might cause scrutiny. With what Bloomberg did to gun dealers with his Mintz Group "investigative teams" is enough to trigger this type of response. He does not know you and for all he knows, you were antis or undercovers trying to set him up. You could very well encounter this same response in a store.

Whether or not his fears are legally founded is something I'd have difficulty answering without consulting a knowledgeable attorney, so I can see where he figured the profit he'd make on a $450 sale was not worth taking any risk.

I wasn't sure if I wanted to post this, but then thought, what the hell, particularly after reflecting on the sacrifices made on behalf of Liberty, including efforts some are making this day, to the scorn of their inferiors.

Part of my efforts to promote my Gun Rights Examiner columns includes a Craigs List outreach in their "Politics" section. I know over there I should probably stick to MLM scams and STD hookups, but every day I ask readers here to help share the links, and I never ask anything of anyone I don't do myself.

Simply Put Questions for NRA About Proposed CA Magazine Ban

Simply put, SB776 would mandate the registration of all magazines capable of holding more than ten rounds of ammunition. The possession of unregistered magazines would be a crime and punishable up to a year in prison. [More]
Equally simply put, I have two questions:

If it passes, will this be another one of those existing/on the books gun laws you'll recommend enforcing?

And will you sponsor another registration session like you did for the firearms these magazine are made for?

Appropriate Charges

I know that checkpoint--I've driven through it many times. The road to Yuma has long stretches of mountains and desert where you're literally on your own, miles and miles away from any help. It's a hell of a thing to make a man choose between his family's safety and the potential loss of his freedom.

I'm lucky I didn't get what I deserved. I'm sure if I had, there'd be no shortage of critics saying I made us all look bad.

But back to the video: I must point out we only have one side. I must also point out that if what he says is an accurate representation of what happened, any beasts who would do this to a citizen are domestic enemies.

How'd You Like a Smoldering Malpractice Suit?

My (rather conservative) British father-in-law was visiting recently around the time that four Oakland police officers were killed by gunfire. Watching the news coverage, he said to me, "I just don't understand America's obsession with guns." I considered telling him about the Wild West of yesteryear and John Wayne and Clint Eastwood and of the perceived sanctity of the Second Amendment. But, then I thought about it as a father and as a physician and replied simply, "I don't either."
I left this comment here:
Hey, Doc--I've been getting this whining noise under the hood of my car followed by a series of muffled thumps. The engine light comes on after about 5 minutes and the temperature gauge needle pegs into the upper range.

What do you think it is?

What? That's outside your area of expertise, certification, training...?

You have credentials on giving out advice on guns, right? So if a patient follows your advice and disarms, and then gets hurt or killed, your malpractice insurance will cover you because you did everything according to your training, right?

Obama to Back International Gun Control Treaty

President Obama will announce in a visit here today that he will push the U.S. Senate to ratify an inter-American arms trafficking treaty designed to curb the flow of guns and ammunition to drug cartels and other armed groups in the hemisphere. [More]
In yesterday's Gun Rights Examiner column, I talked about a "global gun control" column in The New York Times by Antonio Maria Costa, Executive Director of the U.N. Office on Drugs and Crime, and I linked to the UN Firearms Protocol.

This is a more regional approach, but as you see from the signatories, it's nonetheless extensive. What the WaPo did not bring us is the text of the treaty itself. That way, their readers can make up their minds based on what their "Authorized Journalist" tells them to believe.

Here it is--read it.

Candidly, legalese makes my eyes glaze over. So I may be totally off-base, but according to this, could "illicit manufacture" of ammunition include reloading? What about people who make their own black powder rifles? And what's the deal with extradition?

Hopefully some fine legal minds will weigh in. I do note one reference that concerns me:
U.S. gun-rights groups participated as observers in drafting the treaty, which experts say includes language stating that it does not impinge on the U.S. Constitution's Second Amendment.
I understand the motivation to do this--I really do. It's just that, to my mind, an American leader would tell foreign powers to mind their own damned business and keep their tyrannical mitts off our Bill of Rights if they know what's good for them.

I said as much in this old Guns and Ammo column:
Proposing that American gun-rights advocates confer with the United Nations is not only a waste of time and resources that are needed at home, but also lends such venues unearned legitimacy--as if the UN should have any stance on American liberty other than to shut up and learn.
Which resulted in this from my good friends at the NRA Members Councils:
Yet despite this, those like David Codrea, in an article in the September 2003 issue of “Guns and Ammo”, would continue to council disengagement, retreat from the global battlefield, and a kind of pseudo-isolationism that fails to recognize that there are no protective oceans to hide behind in a world-wide battle of ideas. It is apparently more important for Codrea and his ilk to maintain an ideological purity of thought, rather than achieve any of the incremental positional successes that could best guarantee eventual victory. What is more, it is hard to imagine how an almost Islamist-like exclusionary world-view will enable the Codreas of the world to convert more than the occasional wandering “Aryan” to the paradise of a rapidly diminishing gunowner “reservation”.

Still, it's obvious that the government needs to do something. Perhaps government officials just need to work out a way to better control gun ownership with stricter rules on who can own a gun and what gun owners have to do to earn the right to possess one. They also need to put a limit on the number of weapons gun owners can possess and develop stricter penalties for sellers who don't abide by the laws when selling weapons. It may or may not help, but they need to take some kind of action.

We're the Only Ones "Do as We Say, Not as We Do" Enough

Officer Karen Dula did television interviews on local stations in 2006 advising center city bar hoppers not to drive drunk...

It made waves when Dula, then 27, was arrested -- in Uptown of all places -- by the state highway patrol at 1:30 a.m. on Jan. 11 for driving drunk....

Dula was not only still working for the department, but was working as a patrol officer in the department's Metro division, which covers Uptown. That means she can ticket and arrest other drivers for breaking the law, including for drunk driving. Adding further insult to irony is the fact that Dula, who lost her license for 30 days, had to go to court to get her driving privileges reinstated during work hours so she could drive to and from work -- and drive her patrol car.
