We're the Only Ones Who Don't Have to Show You Any Stinking Badges Enough

More than 40 business executives and other professionals appointed as special reserve deputies by erstwhile Orange County Sheriff Michael S. Carona have reported their badges and IDs lost or stolen, including his chief political and legal advisor Michael Schroeder -- who lost two shields...

The Professional Service Responder ranks have long been riddled by controversy. Carona created the special category of reserves shortly after he took office nine years ago and filled it with some of the county's richest and most powerful residents. Many are also campaign contributors, leading to allegations that Carona was doling out badges to allies.

Civic luminary "Only Ones"--now what could go wrong with that? Forget the badges--did they get guns, too?

And why can't I get this clip out of my head?

Fincher Conviction Affirmed

We affirm the conviction and remand the issue of Fincher’s eligibility for court appointed counsel to the district court for further inquiry...

Accordingly, under Heller, Fincher’s possession of the guns is not protected by the Second Amendment. Machine guns are not in common use by law-abiding citizens for lawful purposes and therefore fall within the category of dangerous and unusual weapons that the government can prohibit for individual use.
So much for the federal courts. So much for "every other terrible implement of the soldier, are the birthright of an American." We all see the "common use" citizen-instead-of-soldier bait and switch fraud here, right?

So much for "shall not be infringed."

Circular logic: We have usurped authority to prevent you from having arms that could threaten our grip on power, so they're not in common use.

Tell me the Founders intended for corrupt judicial decisions to be the supreme law of the land--yet that's what we have, when rulings affirm federal courtrooms are Constitution-free zones. Who are We the People to argue it in court, or to judge the law along with the facts?

There is no "legal" recourse--at least none that will be recognized by those rigging the game. Some will point out that contention is wrong, and argue something ultimately depending on majority rule--as if the hive has a collective claim to your rights.

No, the fraud has been nicely played. But then we knew those in power don't give it up if they don't have to.

More at The Volokh Conspiracy. Commentator Brett Bellmore has it exactly right:
No new innovation can start out "commonly owned", hence the government can ban every new firearm.
It's what I feared when I wrote "Things to Come" back in 2002 for Guns and Ammo (not online and it's copyrighted, so I can't post the entire essay here):
It's been said that a battle isn't won until a man with a rifle occupies the ground. We must keep in mind that someone probably once said the same thing about spears.

Shameless Plug: The Heller High Watermark

I’ve said before magazines are poor places for developing stories — the time between events and publication may be months, and assumptions may be proven wrong in the interim.

Nonetheless, we’d be remiss if we didn’t highlight the June 26 Supreme Court ruling in District of Columbia v Heller, wherein the majority held “The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia …”

That’s the first time they’ve so ruled, and as such, it’s huge. But as with all things, read the fine print.
"The Heller High Watermark," dealing with this summer's Supreme Court Second Amendment ruling, is my Rights Watch column for the October 2008 (that does not seem right!!!) issue of GUNS Magazine, on sale now at judicious newsstands throughout the Republic.

We're the Only Ones Likeable Enough

A former police sergeant convicted of raping four women was sentenced to 440 years in prison Tuesday...

Prosecutors used dozens of witnesses and evidence found in Pelo's home to portray him as a man obsessed with violent pornography who paradoxically wanted his victims to like him.
I must have missed that chapter...let's see:
Six ways to make people like you
1. Become genuinely interested in other people.
2. Smile.
3. Remember that a person's name is to that person the sweetest and most important sound in any language.
4. Be a good listener. Encourage others to talk about themselves.
5. Talk in terms of the other person's interests.
6. Make the other person feel important - and do it sincerely.

Nope--nothing about raping them. Maybe that only works for "Only Ones."

Comparing Obama to McCain on the single issue of the right to keep and bear arms
Fine.

I would like to know who's behind it. I'd be surprised if I was surprised.

Here's the thing--we know The Lightworker is bad.

I need to hear more than the republican is comparatively less bad.

We just saw a reputed draft of the democrat platform on guns. In it, I see the Bush Doctrine on "assault weapons" and the McCain Doctrine on "gun show loopholes."

So warnings from the right notwithstanding, let's see what the GOP platform has to say. If it's more meaningless feel-good platitudes with no strong guarantees and pledges to roll things back, don't expect that to put a fire in anyone's belly.

We're the Only Ones Bridging the Gap Between "Us" and "Them" Enough

A New Orleans judge on Wednesday dismissed charges against seven policeman accused of killing two people on a bridge amid the chaos that followed Hurricane Katrina in 2005.
Turns out not only did the dumb ass proscutor screw up, but:

Homicide detectives limited their extended probe into the incident to mostly police witnesses. The investigate report, which cleared the officers, based its conclusions, in part, on the statements of a man who was pretending to be a St. Landry Parish sheriff deputy, but who in fact turns out to be an impostor with a criminal record.

Physical evidence wasn't picked up by police right after the shooting. Instead, officers went back to the scene seven weeks later. At the same time, the police department allowed some evidence to be discarded, such as the rental truck used by officers after the storm, which they drove the bridge when they received a call about officers in possible distress.
Nothing to see here--just standard Big Easy "Only Ones" procedure.

More from the "They Hate Us Because We're Free" Department

Answering a question about his approach to combatting crime, John McCain suggested that military strategies currently employed by US troops in Iraq could be applied to high crime neighborhoods here in the US. McCain called them tactics "somewhat like we use in the military...You go into neighborhoods, you clamp down, you provide a secure environment for the people that live there, and you make sure that the known criminals are kept under control."
I'd say this has the potential to be just as scary as anything Obama might be up to.

Give Me Back My Property

From Len Savage:

Acting Director Sullivan,
Mr. John R. Spencer
Chief, Firearms Technology Branch
244 Needy Rd.
Martinsburg, WV 25405

August 12, 2008

Dear Mr. Sullivan,

I have not heard from you or the ATF since our last communication. I have attempted several times on behalf of Historic Arms LLC (hereafter the Company) to speak with John Spencer, and left messages for him to call back.

Your letter (3311/2008-642) of July 22, 2008 informs the Company that you were going to proceed with forfeiture proceedings. The Company asked that you proceed without delay.

The Company has not received any notice of proceedings. You have seized Company property without any cause or court order to date. The company firmly demands the return of the firearm in question. The company also firmly stands by it’s finding that the ATF applied testing methods are invalid, therefore FTB classification is also found to be invalid, and not supported by documents issued by ATF or basic common sense.

Furthermore your claims of having rights to seize and forfeit the property is meritless-- please see your own policy:

Title 26 Seizures for Forfeiture

Overview:

There are only two methods of forfeiture under the Internal Revenue Code (Title 26), administrative and civil judicial. These methods are commonly referred to as "code forfeitures" or "Title 26 forfeitures." There is no provision for criminal forfeiture. Only property used, or intended to be used, to violate the Internal Revenue laws can be forfeited. Proceeds of such a violation is not forfeitable. In addition, there are no "tracing" provisions with code forfeitures. Accordingly, the property purchased with proceeds is also not forfeitable.

Authority Granted in 26 USC §7301

Title 26 USC §7301 provides for the forfeiture of taxable property which is in the custody of any person intending it to be sold, removed, concealed, or deposited to defraud the United States of the tax, or is possessed with the intent to avoid payment of the tax. It also provides for the forfeiture of assets used to manufacture, contain, or transport the taxable property that is the object of the fraud or evasion scheme.

Authority Granted in 26 USC §7302

Title 26 USC §7302 provides for the forfeiture of any property used, or intended for use, in violation of the provisions of the Internal Revenue laws or regulations prescribed under such laws. It is the more commonly used statute for a Title 26 forfeiture. The wording of 26 USC §7302 is very broad. Although 26 USC §7302 authorizes the seizure and forfeiture of any property used, or intended to be used to violate any of the Internal Revenue laws, it is not to be used as a substitute to the collection of taxes. Consequently, most Title 26 forfeitures have involved property used to violate the provisions of the wagering tax laws (26 USC §4401, §4411, and §4412), the sale of motor fuels (26 USC §4081 and §4091), and, to a lesser degree, the equipment used in these tax fraud schemes. Forfeiture can also apply to other sections, such as the sale of tires (26 USC §4071).
Mr. Sullivan, even your own staff documents the fact that a “Notice of Manufacture” [ATF form 2] was filed by the Company. There was no attempt to defraud or avoid paying tax. As Mr. Spencer pointed out in his last letter (3311/2008-642) of July 22, 2008, I am a Special Occupational Tax Payer in good standing.

Therefore please return the property of the Company [the firearm in question] immediately.

Respectfully,

Len Savage
President,
Historic Arms LLC

(II) take the steps necessary to preserve its right to maintain custody of the property as provided in the applicable criminal forfeiture statute,
the Government shall promptly release the property pursuant to regulations promulgated by the Attorney General, and may not take any further action to effect the civil forfeiture of such property in connection with the underlying offense.

Yuri Orlov reminds us that some, who would presume to lead us in the "gun rights" struggle, use this term as a pejorative.

I'd contend that says more about them than it does us.

Take the Only Ones Challenge!

To paraphrase Glinda, from "The Wizard of Oz":

Are you a good Only One or a bad Only One?
There's competition for the meaning of the term. Ahab/Caleb has started featuring stories illustrating the good they do.

Good for him. I've certainly never claimed exclusive rights, particularly since it was coined by someone else.

I do have a challenge for him, though:

Go up to the "Only Ones" you praised in Chicago or Los Angeles. Congratulate them on their bravery. Tell them how much you admire them, and how you sympathize with them risking so much in often thankless and unappreciated tasks. Shake their hands and offer your profound respect and appreciation.

Then, tell them that in accordance with the Supreme Law of the Land--the one that says "the right of the people to keep and bear arms shall not be infringed," you are carrying a pistol in order to protect yourself, your family and your community.

And then let us know how much they respect you, and which definition of "The Only Ones" manifests itself--yours or mine.

Yeah, no kidding.

But my question for you, deputy, is if you're so hard up for a job that you'll let yourself be degraded, why should anyone think you'd stand up for a citizen or a prisoner being abused?

An elderly gentleman asked the instructor, “I live in a nice neighborhood. My wife and I go walking nearly every evening. Do you think I should take my gun with me?”

Incredibly, the instructor replied, “Well, that’s a personal decision that you will have to make for yourself.”

I wanted to scream, “Of course, you should! There are no safe places!”

For Whom the Bell Tolls

Why, for you, of course.

See, that's the problem in this country--particularly in those areas where gun abuse is prevalent: Too much individual responsibility and freedom. Why, if only we'd assume collective responsibility for the choices of others, not just for gun ownership, but for everything, just imagine the "social justice" we could achieve!

Repeat after me: Less personal accountability! More collective guilt!

Seattle police Sgt. Rich O'Neill, president of the Seattle Police Officer's Guild, said he had not been contacted regarding the shooting, but said that officers have a right to protect themselves and should be given the benefit of the doubt while the allegations are investigated.
And I give Sgt. O'Neill the benefit of the doubt that he would have made an identical statement had the gunfire come from the Hells Angels rather than the Iron Pigs, and that none of them would have been arrested.

A Maryland Shooter

Last night at 12:30 pm a MD State Police "Armed Response Team" showed up at our door. I was dead asleep, my Wife was laying some ceramic tile on our basement floor when our driveway alert went off several times. She looked at the camera monitor and screamed that Police in Assault gear were running up to our front door. That made me sit straight up from a dead sleep...
Read the whole account and then come back for some commentary.

Done?

The following observations were sent to me by a regular correspondent and blogger--who, this time, fears making his identity known for reasons he explained to me and which I will not go into now. Here is what he had to say about this "situation":
There are no laws in the State of Maryland whatsoever that cover the use of ammunition logs at the point of sale. None. This is pure policy intimidation on the part of local and State police and if you are in Maryland and presented with a requirement to sign such a log, REFUSE politely and call a lawyer.

There are no laws in the State of Maryland that restricts the type or quantity of ammunition you may possess. The only requirement is that you are not permitted to purchase handgun ammunition if under the age of 21. If the police show up and question you about your purchases or their quantities, REFUSE politely and call a lawyer. Request to see ID and demand to see a warrant.

There are no laws in the State of Maryland that restrict you to regulated firearm ammunition for firearms that you own that are on record as having been purchased in the state. The fact the police are using these purchase/registration lists is yet another reason to abhor gun registration and to use it as a club against anyone who suggests it is a "safety measure".

There is no requirement in the State of Maryland that requires to you register firearms that are regulated that were purchased legally before moving into the state. Registration is voluntary. The fact that the police is suggesting a law-abiding citizen register their arms to prevent further harassment is an abuse of their authority. If they suggest it, REFUSE politely and call a lawyer.

And lastly, there is no requirement in the State of Maryland or anywhere else in this country to let any police officer into your home or answer questions about your law-abiding activities in the absence of a warrant detailing the premises to be searches, items to be seized and/or the charges you are facing. If an officer asks any of these things of you, REFUSE politely and call a lawyer.

I have no words to describe how it feels to live in Maryland under such a threat for having done nothing wrong. To any gun owner in Maryland who thinks such "ammunition logs" or use of the regulated arms purchase registry in such a fashion to be no big deal, think again.

If you own regulated arms in Maryland, buy your ammo out-of-state. Don't give anyone anyone a single round of ammo to use against you. Not one.

Then get out if you can.

Follow the Results

We're the Only Onesh Four Timesh the...Who Put That Fence There?

An Indianapolis police officer arrested in a drunken-driving case Sunday has been involved in two prior alcohol-related accidents in which he was not charged. His patrol car was involved in a third case in which charges are under consideration.

All of the accidents involving officer George Leon Benjamin, one dating to 2002, involved city vehicles.

...Benjamin refused to take a field sobriety test, the report said, but a breath test later determined his blood-alcohol level was 0.32, four times the level at which a driver in Indiana is considered intoxicated.
So he's been getting away with this for years--with the department's knowledge. That means this is the "Only One" judgment they knowingly employ to interact with the citizenry.

I wonder how many convictions, where much of the evidence was based on his testimony, will be reevaluated?

Does Demetress Brown equating 20 shots to "a war zone" seem expert and definitive, or do you think maybe it's more likely we're witnessing the fruit from a tree planted back in 1988 that's been carefully watered and nurtured by "Authorized Journalists" and the entertainment media?

"Les Misérables" Opens in Boise

A 19-year-old Boise man is charged with felony delivery of marijuana after police say they found a gram of pot and $2,000 in cash on him early Friday morning.
Plus they charged him with resisting arest because he was "uncooperative."

I wonder why--they've proven to be so reasonable. Just like the lifetime gun ban he now faces.

Question and Answer

"Jerry" writes:
Has any comparison been made to "law abiding citizens" who stop a crime and LEOs who stop a crime?
I'm not aware of such a comparison but it seems logical that cops generally arrive after the crime has been committed. One of the problems would be people who stop a crime and don't report it because they don't want to get in trouble for illegal carry. There are "studies" claiming cops prevent crime, but I have no idea how they derived their numbers, as they are typically program or budget justifications, as opposed to disinterested studies with no incentive to yield a particular outcome. Gary Kleck would probably be your best bet for defensive gun uses (including unreported ones), and John Lott for concealed carry deterrence and media bias in not reporting it. But I don't know if anyone has taken what you're asking for and put it into one nice, neat and peer-reviewed package.

How about it? What's out there that I'm oblivious to. On this, I mean...

AOL Censoring RKBA News

From Dan Gifford:

AOL's refusal to deliver the August 5th Second Amendment Group email because it contained a link to an AOL banned news source which AOL cannot or will not name has elicited a number of comments like this:

"Dan this is really scary. You absolutely MUST tell those on your email group who are on AOL to get OFF that service right now, and to tell AOL why they are leaving. There is simply NO reason to subscribe to AOL any more. There are plenty of alternatives. This is the beginning of a slippery slope. Unless subscribers nip this in the bud right now, every single internet service is going to start censoring based on frivolous complaints from other subscribers. We must insist on NO censorship at all, complaints or no complaints. And I mean NO CENSORSHIP, even against Nazis, Jew-haters, etc." (the writer is Jewish)

A few others have written that they just cannot believe that AOL effectively censors the content of their email. Well, it does. If that bothers you and you would like to complain and perhaps switch from AOL,the AOL reference number for this censorship incident is 174241379.

NOTE:

AOL customers have not received the last Second Amendment Group mailing because AOL won't allow you to have it. AOL won't allow you to have it because it contains links to stories or news organizations that offend some AOL subscribers. That means AOL's censoring screener rejects any email containing them, including ones onto which my email was pasted.

Which links among the various major news and academic sites could possibly be so offensive and unsettling? "Jevon," the AOL representative I spoke with this morning could not say or would not say. He just said the email requires further investigation. However, he did say that AOL screens all emails for appropriate content and that ANY site link in an email that "enough" AOL customers have complained about will trigger a rejection. "Enough" in this context, he said, could mean as few as 50 or as many as 100.

So I asked, does that mean if 100 AOL customers say that they are offended by stories at The New York Times' site, that site link would be listed as one containing offensive or inappropriate content and cause a rejection of email containing it? "Yes," Jevon said.

Now, I'm often offended by what I see on The New York Times site and I'm glad to learn how easy it would be to mess with Frank Rich fans. Even so, if I were an AOL customer, I'd be switching to an ISP with more common sense.

This isn't a new story so much as a continuation and first-person confirmation of an old one from a credible source.

We're the Only...Sa-ay...Are Those Fruit-Filled...?

The Chicago Sun-Times says a cop in the Windy City was suspended for 15 months after the Police Board heard evidence that she "us[ed] her gun and badge to demand free coffee and pastries from six Starbucks stores on the North Side between 2001 and 2004."
I was telling people who sent me this that it was an old story and I'd already covered it--but that other shakedown took place in Florida.

And I must admit I laughed out loud when I read the last sentence in this story:
Elsewhere in Chicago, another police officer was fired after he admitted having a sex with a rookie's wife inside a local precinct.
Remember: They're not just "Only Ones," they're Chicago "Only Ones." Better than me 'n you in every way.

In This Paper's Opinion

Offering the first significant gun legislation since the U.S. Supreme Court's recent ruling on the District of Columbia v. Heller, (the landmark case outlining the legality of gun laws) Representative Carolyn McCarthy (NY-4) has introduced a commonsense bill that tightens the criminal background check system by requiring background checks for all gun store employees and dealers.
Hey...wait a minute...that sounds word-for word like McCarthy's own statement...so much for hard-hitting independent watchdogging over at the Three Village Times.

I guess what this bill is about is--because there's a federal law against prohibited persons having guns--there needs to be another federal law prohibiting prohibited persons from having guns. And I suppose if that doesn't work, we can just keep adding layers of prohibition. Hey, when you're in public/private partnership with the "news" media, it doesn't have to make sense--they'll run interference for you and make it look like you know what you're doing.

Oh, and there's also a "fire sale loophole," just in case a dealer exterminated by BATFU for "willful violations"--you know, stuff like paperwork errors--wants to avoid complete financial ruin. This will make sure the boot continues crushing until the last bit of ooze is ground into the dirt. Because, you know, governments are instituted among men to secure the blessings of liberty...

I almost missed this part:
Thanks to Representatives McCarthy and Kirk, there are now bills introduced in Congress to fix these problems...
That would be Mark Kirk.

You'll recall I pointed out how Kirk was vulnerable, and how gun owners could deny him that critical few percentage points to unseat him--as an object lesson to other turncoat republicans. Well, it looks like the one principled alternative is no more.

It's telling when non-"extremists" spread the meme that we "radicals" have given up on working within the system, when in fact, political options are introduced and they ignore them. So now 10th District voters can justify to themselves how pulling the lever for Gungrabber R is a lesser of two evils choice than Gungrabber D, and anything else will be a wasted vote.

The one question I've never seen answered: How far down this path of failure are we supposed to allow ourselves to be led?

A Man of Letters

...if A were to say all this to B, B would naturally conclude that A himself was the most impudent and dangerous burglar that he (B) had to fear; and that if he (B) wished to secure his property against burglars, his best way would be to kill A in the first place, and then take his chances against all such other burglars as might come afterwards.
Ah, Lysander Spooner, that irascible but loveable old curmudgeon. I guess when recognized historical figures talk about killing government agents, it's no longer threatening and actually becomes admirable and wise.

What a Difference a Percentage Point Makes

But being 99% honest is no longer enough.
This is "being 99% honest"?

He professed his love for his wife, who had an incurable form of cancer, saying, "I've been in love with the same woman for 30-plus years and as anybody who's been around us knows, she's an extraordinary human being, warm, loving, beautiful, sexy and as good a person as I have ever known. So the story's just false."

A Mayor Against Guns

Shortly after Mayor Kwame Kilpatrick wakes up in jail this morning -- still reeling from becoming the first sitting mayor in Detroit's 307-year history to spend a night behind bars -- Michigan Attorney General Mike Cox is expected to charge him with felony assault.

I know it's not kind or mature, but permit me my Nelson Muntz moment.

GUNS Magazine: August 1958

Chicago, Ill. Dr. Blaine Ramsay, 72, opened the door to his consulting room late at night to three visitors, two men and a woman. One of the three said, 'This is a stick-up," and pushed Dr. Ramsay back into a chair. They demanded money, ordered Dr. Ramsay to take his hands out of his pockets and get busy. Dr. Ramsay did. He hauled a .38 caliber revolver out of his pocket and started shooting. One of the men, an ex-convict, fell, badly wounded; the other man and the woman fled. This is not Dr. Ramsay's first experience in Such matters. In 1955, he killed another ex-convict who tried to hold him up in his office. Hold-up men should leave Dr. Ramsay alone, go to New York where there's less chance of encountering an armed victim.

Or they could just wait a few decades for Chicago to catch up.

The August 1958 issue of GUNS Magazine is now online. I'd like to think of it as a special PETA double feature issue: Not only does Roy Rogers execute a bear, but Elmer Keith goes all the way to Africa just to murder a rhinoceros!

Say "Cheesy"

To make good on his offer to help Chicago combat violence, Gov. Blagojevich envisions putting speed cameras on interstates across Illinois -- and using the revenue to form an "elite tactical team" that would operate in Chicago and other cities...

According to Trent, new State Police teams will stop motorists for traffic violations on Chicago expressways near high-crime areas. The troopers will also look for gun and drug violations. They can communicate with Chicago Police officers on radios and come to their aid when needed.
Ah, the "hog butcher for the world" has figured out a new way to fill the trough. And the fascists admit their speed traps have nothing to do with roadway safety and everything to do with highway robbery.

"PARANOIA"

Brady Bunch's Knickers in a Twist Over, uh, Me?

by Mike Vanderboegh

A Rich Man

If a man is known by his enemies as much as his friends, then I am richer today than I was last week. The anti-liberty, anti-firearm Brady Bunch, it seems, has noticed my little letter to the Capitol Times of Madison, Wisconsin -- where even the trees lean hard to the left. It is, they say, an example of "bunker paranoia," describing it as a "crackpot's rant," "morally degenerate," "hyperbole from a possibly unstable individual," and my favorite, "immoral or . . . street-corner gibberish uttered by one who wears a tinfoil hat." See: http://www.bradycampaign.org/blog/2008/08/06/the-nra-spy-gate-and-bunker-paranoia/

I wondered briefly if they had been talking to my ex-wife, the equally liberal public employee and Democrat Wicked Witch of the North, who resides in Columbus, Ohio, and who is every now and then reportedly spotted on her broom flying in the airspace over the beer plant on I-270 north of town, skywriting in black, "Surrender Your Guns" in the bright blue Buckeye sky. Well, maybe those reports ARE exaggerated.

What isn't exaggerated is the Brady Bunch's apparent alarm over my letter and it can't be a case of being misquoted, for The "Brady Blog" reprinted the entire letter as Prosecution Exhibit #1. By their own account, here is what scared them: "In the wake of the Vanderboegh letter . . . armed revolt has been treated as a legitimate policy answer to gun control measures by one blogger after another in the gun community." Huh? Like it never was? That would have come as shock to the Founders. What did the Brady Bunch think those bumper stickers, which first appeared in the 1970s, meant? "You can have my gun when you pry it from my cold dead fingers."

Of course, the Brady Bunch is not truly upset by that prospect in itself, since they propose that other people's sons and daughters in federal service take the risks and do the killing for them of those recalcitrant "morally degenerate" gunowners who refuse to see the wondrous future of their good intentions. They certainly do not envision themselves enforcing the tyrannical laws they propose. And that is the beauty of collectivism. It is power without personal consequences to the ruling elite. But the obverse of the "cold dead hands" coin is this: a man willing to die for his principles and his country is almost always willing to kill in defense of them too.

My sin was in reminding the Brady Bunch that such tyranny might indeed have personal, unintended consequences and THAT they CANNOT abide. The fact that this "inconvenient truth" (to quote one of their icons), is indeed true means nothing. Truth is spit in the wind to such people. This is because all tyranny requires illusion to succeed.

The Three Illusions of Tyranny

There is first the illusion that your selected enemies are somehow defective, not worthy as human beings, whose opinions, even lives, do not matter. As, in, for example the use of language like "gun nut," "religious fanatic," "crackpot," "morally degenerate," "unstable," "immoral," or in other countries and other times, "dirty kaffir," "degenerate Jew," "Bosnian cockroaches," "capitalist vermin," etc.

The next necessary illusion is the one that they and they alone are the Keepers of Truth. Ergo, anyone who doesn't believe as they do is one of the "untermenschen" categories above. This illusion excuses them from any responsibility for whatever human crockery is broken in their campaign to perfect humanity. This is why only they are principled, only they are reasonable, only they are, indeed, sane. For to them, opposition to their liberty-stealing plans only occurs to "madmen" who refuse to see the eminent peace and sanity of their schemes. This illusion works not only for themselves, but for the uncommitted audience watching, for they quickly absorb the point that if you don't want to be labeled as one of these "crackpots" you will fall in line with the rest of the "reasonable" people, which is to say, with them.

The last and most important illusion they are selling is that they and their friends represent THE majority, and thus the rights of the minority can be discounted once they have been out-voted. This is the democracy of three wolves and a sheep sitting down at the table to vote on what, or who, to have for dinner.

The Founders were distrustful of democracy unrestrained by constitutional republicanism. Thus, the Constitution as written provides a thin menu for would-be wolfish American tyrants, which is why they have been so assiduous in diluting and destroying it over the past seven decades, adding items a la carte so that they may be fed off the liberty and substance of the people.

But it is in this last illusion, that they represent the majority, that they are often left like the Emperor without his clothes, vulnerable to the first clear-thinking kid with 20-20 vision to point out the royal dinkie dangling in the wind. Denunciations like this one by the Brady Bunch are merely the latest iterations of the pompous, silly and ineffectual Wizard of Oz, shouting "Pay no attention to the man behind the curtain!" I must say, I am honored.

You know, they really aren't very smart, these Bradyistas. By reprinting my letter in toto (no, not the dog), they have ensured it will be read by a much wider audience than the few hot-house liberal Madisonians (no relation to James) who choked on their morning lattes when they read it in the paper. By conflating it in the same breath with the NRA spy case and trying to tie my constitutional absolutism to those compromising losers discredits the theory in an instant to anyone with half a brain. I resigned the NRA many years ago over their political compromises with the likes of the Brady Bunch.

Indeed, the Bunch is only upset about the use of paid spies because it is their side which is now being spied upon. Where were their voices when the ADL and the Southern Poverty Law Center got caught doing the same thing to the "right wing"? I assure you, that when the Risen Lightworker Obama becomes the great and powerful Oz, these mokes won't mind a bit if his administration, restrained by inconvenient law, contracts with some mercenary outfit such as Blackwater to spy on his perceived "domestic enemies" -- you know, like American gunowners. For my part, I have no sympathy for the NRA nor the paid spy nor the collectivist gun control "lobby". A pox on all their houses.

"Tin-foil hats"

One final point which bears on the third of those collectivist illusions. Count them as you will, the Brady Bunch and their ilk are not a "majority" of the American people. But that's OK, neither are we. Here's the difference. It is they who are seeking to take our liberty and not the other way around. We want nothing from them. We do not seek to tax them out of their hobbies. Nor do we seek to ban their latte-sipping, nor their limousines, their gated communities, their armed security guards -- not even their right NOT to bear common sense. On the other hand, they want much from us, including something that the Founders considered key to the whole liberty thing: firearms in the hands of the people which enable them to resist a predatory government. Yes indeedy, Sarah, were talking about "armed revolt . . . as a legitimate policy answer to gun control measures." If that's "tinfoil hat" so was Lexington and Concord and if Thomas Jefferson were still here, he'd make tinfoil hats look stylish.

The Brady Bunch will get their will by conjuring their illusions and jawboning us into submission if they can, but they do not hesitate to propose the military might of government to seize it if we don't.

"I'm not crazy, Sarah . . ."

It is then, neither "bunker paranoia," "a crackpot's rant," "morally degenerate," "hyperbole from a possibly unstable individual," nor, "immoral . . . street-corner gibberish uttered by one who wears a tinfoil hat," to state plainly and publicly that the Law of Unintended Consequences still rules the world. Nor indeed is it nutty to say that people who wish for other people to be robbed of their God-given liberty and hard-earned property might want to consider for a moment just whose head that boomerang might hit. I'm not crazy, Sarah, I'm merely being polite. And who knows? Tin-foil hats may yet become stylish, if worn with semi-automatic rifle and bandoleer. It's an ensemble thing, I think. Wouldn't look good on you though, I'd guess.

The Mercenary Vanishes

However, one particular photograph from the Times story has drawn more attention than anything else. That picture, which has now been widely reproduced at blogs, shows a long-haired man, wearing a Blackwater tshirt and with a pistol at his belt, passing a box marked “DEA Evidence” to other agents participating in the raid.
And the picture has been removed? Where have we seen that before?

Maybe there's something to the concerns... but gosh--they're so friendly to gun bloggers...

Getting a Reputation

The con case is, well, everything from the aforementioned eye to encouraging more of a gun obsession than the Nerf guns have already inspired. Plus we don't want to get a reputation as the "gun family" in the neighborhood when all his buddies start asking their own parents for one.
Yeah--we'd rather have the reputation of being a bunch of leftard GFWs.

When my youngest was around 7, one of the kids on his ball team was just about the wimpiest boy I'd ever encountered. My son invited him to a movie, but the kid started crying because he was afraid of--not what was on the screen--but the entire experience, including being in the dark. So I had to take him home and miss the show myself while my wife stayed with the other kids--there went two tickets plus the exorbitantly priced drink and candy I'd treated him to. When I got him home, his dad was laying around and when I told him why I was returning the kid early, he said he was aware the boy was scared of movies.

I figured I could either burn his ears off demanding to know why the hell he let me go through the expense and the effort, including paying for missing the experience when he knew this. I was so steamed I knew if I got started it would not be pretty, so I stifled my impulses in the interest of harmony at future games--after all, it was for the kids' benefit, not the parents.

A week later this guy shows up (late) at practice wearing an HCI T-shirt. Suddenly all the pieces fell into place.

That poor kid never had a chance.

We're the Only Ones Ready for Action Enough

Top cop gives gun to prostitute Pamela

When Leading Senior Constable Steven Owen arrived at the Harem brothel in South Melbourne, he was on duty, in uniform, armed - and ready for action.
Blew that one, didn't you, buddy? I mean, Pamela. Oh, that's mean, you were mostly just talking, right?

I just wonder how, on a cop's salary, he could afford to go through "$16,000 in three months on dozens of five- and six-hour sessions" when he was the "single parent of three children."

What I don't get is the big deal about his "still trying to function normally" as an "Only One."

Isn't that what he was doing?

The "Who'll Be the Bigger Oath-Breaker?" Test

Mayor Michael Bloomberg's gun control coalition is asking Democrat Barack Obama and Republican John McCain to answer a questionnaire about their positions on gun issues.
I don't get it--they dropped this bomb last Pearl Harbor Day. Anybody know if there's a new survey, or if Newsday is just a bit behind on the news of the day...?

I'd think by now we'd be able to see their answers.

Bob Barr's (Incomplete) Gun Record

Yes, George Dance addresses Lautenberg, but totally avoids Bob Barr's refusal to repudiate it and apologize.

Without that repudiation and apology, GOA isn't doing their reputation for "no compromise" any favors. It's evident they're jumping through hoops to redirect the argument to what he's done that they like. But Barr's and the LP's nonresponsiveness can only mean he's unrepentant (more like unwilling to take political heat). That GOA doesn't demand a retraction before jumping in to help the guy makes their "F-" rating for John McCain look more than a bit disingenuous.

And I think I've made my views on McCain pretty clear.

I Thought That's What Everybody Was Doing

The question now becomes "What the...?"

So why are the Brady's not decrying this genocide-enabling end product of that slippery slope they say doesn't exist? Why do they "cater" to it instead? They should come down from their guard tower and explain themselves.

Hey, if they can pin responsibility for Mike Vanderboegh on the NRA...

Why Mike Vanderboegh is Right

I'm surprised I didn't notice this before--it's a very well-written defense.

He learned that the HMS Betsy, commanded by Capt. Alvara Lofthouse, was sailing to St. Augustine and contained a huge supply of gunpowder. The Commerce spotted the Betsy and pulled alongside it. The armed crew jumped on board the Betsy and quickly captured the sleeping crew. They were able to unload about 17,000 lbs. of gunpowder when the Commerce was spotted by the HMS St. John, coming out of the harbor. The Commerce departed the area and escaped with their stolen powder. Conclusion: American Victory

Mike Vanderboegh stated his case reasonably and authoritatively. And Kurt and Sebastian presented and defended their arguments clearly and without acrimony.

I do take exception with some of the conclusions, but now is not the time or place to start swinging again. I see a lot of value in the call-in venue for debating differences with more civility than we typically see in the "comments" fusillades.

Two Questions

Democratic leaders in the U.S. House of Representatives have agreed to allow a vote next month on a bill that would end local handgun control in the District, making it easier for D.C. residents to acquire pistols, including semiautomatics, while eliminating the strict handgun-storage requirements imposed by the city.
Sounds good. Why would they do that?

Norton said in a statement that those Democrats "hope to relieve election year pressure by getting a Democratic-backed bill to the floor, out of fear that the [National Rifle Association] will run hometown ads against their reelection."
Ah, OK--two questions: Any chance this will derail Heller II? Should we maybe be having this discussion in a very open way so that we're all on board with the costs and benefits of doing things legislatively vs. judicially?

Quote of the Year

"In the battle of ideas with the gun lobby, we're at a constant disadvantage because we're honest."

This Day in History: August 6

I believe, because I think I can prove it, that your party, to serve an obvious party purpose, exceedingly magnify the numbers of those whom they suppose to take part with you, and you tax us with doing the same.
It's not a new debate...
