MH: Authorities have stepped up patrols. So everyone can 'feel' safer, I guess. One word describe all of this: EVIL. Do not think 'mentally ill' - whoever did this was evil. Period. DC: It was a National Forest, not a National Park, so the ban that will exist until Feb 10 did not apply--NF's abide by the state rules where their territories overlap. That said, both were too young to qualify for handgun permits in VA--another outrage in itself. MH: That is correct. However, in Va., we can open-carry in most places -- EXCEPT in state parks, thanks to Timmy Kaine. I'll send you his pathetic letter later, if I can find it. Virginians can open-carry from age 18 onward. VCDL is covering this. DC: Thanks for the clarification--is the state park OC ban paralleled in national forests? MH: Well, the answer is a bit complicated. The relevant Forest Service CFR reg is 36 CFR 261.8(b): [See gpoaccess.gov for further details] The following are prohibited **to the extent** Federal or ***State law is violated***: "(b) Possessing a firearm or other implement designed to discharge a missile capable of destroying animal life." The problem: Kaine refused to honor an AG opinion which declared that open-carry in Virginia parks is legal. I'll send the documents in a follow up. MH: Here is a brief overview: 1) This is an AG opinion, requested by a strong pro-gun Delegate, Richard Black (his second attempt): http://oag.state.va.us/Opinions/2002opns/02-074.pdf Basically, the idea is if you have a CHP, only the General Assembly, not the state parks department (DCR), can ban concealed carry in state parks. The opinion had nothing to say about open carry. Then governor Mark Warner grudgingly accepted that opinion and had the regs revised to allow concealed carry in state parks. =============== 2) About a year ago, Senator Ken T. Cuccinelli, II requested an AG opinion from the AG Bob Mcdonnell, concerning open carry in state aprks. Here is that opinion: http://oag.state.va.us/OPINIONS/2008opns/08-043-Cuccinelli.pdf [SNIP] I find no specific statutory authority granting the Department the authority to prohibit the open carrying of firearms in state parks. A person’s right to carry a firearm openly is considered universal within the Commonwealth, subject to definite and limited restrictions upon certain locations and classifications of individuals. Accordingly, it is my opinion that the Department of Conservation and Recreation has only such authority to restrict the open carrying of firearms which is expressly provided by law. Thank you for letting me be of service to you. Sincerely, Robert F. McDonnell =================== As you may be aware, McDonnell is running for Governor, and Cuccinelli is running for Attorney General. Once again, it was up to the governor (Tim Kaine) to accept the opinion and order the regs changed. Well, VCDL tried reasoning with his office, to no avail. finally, VCDL received a letter indicating the Governor would NOT honor the AG opinion. VCDL letters page. Kaine's letter [SNIP] DCR's longstanding ban is an important aspect of maintaining the safety and attractiveness of our state parks. Park visitors must have confidence that they can enjoy our parks without concern about the open carriage of firearms. =========== Well, there you have it. I assume you know that Kaine is the new DNC Chair.

Damned American Gun Shows!
UC Davis report finds gun shows as leading source of guns used in crimes...Starring Wal...uh...Garen Wintemute!
This unique report includes hundreds of hidden-camera photographs and video taken from 78 gun shows in 19 states, detailing how American gun shows have become leading sources of crime guns for Northern California, the United States, Mexico and Canada. Also emphasized is the link between gun shows and extreme right-wing political activities and specific action recommendations. [More]

It will also be interesting to see if any of the gun shows or individuals have recourse based on what and who he secretly recorded.

We're the Only Ones Blameless Enough
The tragedy that led to the Adames lawsuit in Illinois occurred eight years ago, when 13-year-old Billy Swan aimed and fired a Beretta pistol at a friend who had come over to play, Joshua Adames, who also was 13. The gun belonged to Billy’s dad, a Cook County sheriff’s deputy. Billy had taken out the gun’s clip before aiming it, believing that would make it harmless. A bullet that had remained in the gun’s chamber killed Joshua. So is Billy's dad hoping to make a buck off his incompetent complicity in the death of a child? That's probably the most disgusting act of blaming others I've ever read about. Seriously.
Billy’s parents sued Beretta, among others, contending that the gun manufacturer failed to warn users of this kind of pistol that removal of the magazine did not make it safe. [More]

Mabell Labe

Fellow patrons had their cellphones temporarily confiscated to prevent pictures from being taken. [More]The nerve of these people.
I'd have refused and dealt with the consequences. Seriously. There's no way I would consent to this.
UPDATE: Some have reported problems accessing this. It still works for me, but for those of you who can't make the link work, here's a screen shot with red underscoring added by me:
Some Questions for Danny Tarkanian on Guns
The Mason-Dixon Polling and Research survey, reported Sunday in the Las Vegas Review-Journal, showed GOP candidate Danny Tarkanian leading Sen. Harry Reid by 49 percent to 38 percent. [More]As far as Harry Reid goes, the NRA is significantly more impressed with him than GOA is. The reality is, NRA is probably not going to give up their relationship with the majority leader over a challenger.
Which means if Danny Tarkanian wants to impress gun-owning Nevada voters, he's got some 'splainin to do--which he evidently hasn't so far...
Now's your chance, Mr. Tarkanian.
Will you answer a few questions?
Will you give gun owners a reason to look to you for leadership?
This looks like the perfect campaign to force this issue. It's not like the anti-gunners have a lock on Nevada. So he can't harm himself by being unequivocal and strong.
I'm sending this to Mr. Tarkanian via email. Whether he responds or declines, you'll know about it.
UPDATE: He passed with flying colors.
We're the Only Ones Hierarchical Enough
A retired Lorain police sergeant has said that when he was on the force, his fellow officers engaged in “nonconsensual sexual misconduct” with members of the public while they were on duty and weren’t meaningfully disciplined for it, according to court documents filed Wednesday. [More]Nonconsensual sexual misconduct”?
Is that "Only One" code-speak for "rape"?
Well, yeah, I understand why there was no "meaningful discipline," seeing as how the immediate response that a rape attempt deserves would deplete the force of so many "bad apples" there apparently wouldn't be that many left in the barrel...
We're the Only Ones Selling It, Loving It Enough
A St. John the Baptist Parish sheriff's deputy booked with malfeasance in office was fired Friday afternoon after he was caught selling Sheriff's Office property on eBay, Sheriff Wayne L. Jones said. [More]Whatever it is, you can get it from "Only Ones"!

Some TN Permit Holders are Now Felons
The effect of the new law is that now even non-violent felons are prohibited from possessing any firearms and also from buying firearms (TCA 39-17-1316) and also from having a handgun carry permit (TCA 39-17-1351) even if they have previously had their full rights of citizenship restored by a Tennessee court. They cannot hunt with a firearm. They cannot have a firearm in their home for self-defense. They cannot work as an armed guard. They cannot work in an armed law enforcement position. How did this happen?
They are unindicted felons instantly on July 1, 2008 whose names are in many state databases as firearms owners. [More]
Apparently, the current NRAILA lobbyist chooses not to consult me or to my knowledge any other practicing Tennessee attorney with experience in these areas.Well, perhaps "the current NRAILA lobbyist" has superior credentials...? I'd think working for the Council on Foreign Relations would count for something...

Gun Registration is NOT Constitutional

Where I can and do disagree is with any representation that the Founders would have considered mandatory gun registration constitutional. These were the people who wrote "shall not be infringed" into the Second Amendment, and they did not delegate to government any power over gun ownership. [More]Today's Gun Rights Examiner column disagrees with some "reluctant... 'pro-gun scholars and advocates'" who, for reasons of their own, feel compelled to make unwarranted public concessions to the enemy.

Are You Doing Business with Anti-Gun Companies?

There’s an old bumper sticker that says "Ted Kennedy’s Car Has Killed More People than My Gun." Perhaps it’s time to create one that says "Sara Lee Has Killed More People than the Manson Family." And to wonder why they don’t focus on controlling their product quality instead of our guns. [More]Today's Gun Rights Examiner posts an old article a magazine feared to publish. I posted this several years ago on WarOnGuns, but most readers will not have seen it before.

'Travel Icon' Frommer Just an Anti-Gun Bigot

Two truisms come to mind that Arthur's anti-gun adventure confirms: Write what you know and there's no fool like an old fool. [More]Today's Gun Rights Examiner column looks at an ignorant old fool.
