There's a meme wending its way around internet forums and the like that she'll recuse herself, since she already ruled at the circuit court level that the Second Amendment does not restrict the power of states to infringe on the right to keep and bear arms. Some seem to be under the impression that she ruled on McDonald, which she did not (she ruled on Maloney v. Rice), and because of that, the prospect of overruling herself will present a judicial ethics conflict. [More]

I remember when I was first starting out WarOnGuns, and put a bunch of "established" gun bloggers on my list who, it turned out, would not give me the time of day. I thought that was pretty snotty and promised myself I would never be like that.

Like it or Not?

Edmund Cooper says:

Better that one cooperates with the police when one is the object of their undivided attention. Like it or not, they are in charge on the street.

Police are highly emotional and have predictable responses. Not smart to make them feel threatened. [More]

This is a comment posted to a GRE column from the other day.

I think Mr. Cooper's observations raise some debatable points.

On the one hand, I can't argue with him. We've seen those "predictable responses" happen time and again.

On the other hand, with outrages that seem to be increasing to a breaking point, I question that this will always be the "smart" option...

Gun Groups Fire Back at Feds with Firearms Freedom Act Lawsuit

What if an FFL was not acting in his capacity as a federal licensee to manufacture for personal use, or to transfer firearms strictly within a state? Or what if a person so engaged was not a federal licensee at all?

Today's Gun Rights Examiner column covers the lawsuit filed against the feds by SAF and MSSA, and includes a copy of the complaint.

I know some have dismissed this strategy. I also know that this is a good case in terms of being consistent with founding intent, but admit seeing unconstitutional tyranny prevail in federal courts is an outrageous possibility. Still, there's a very important fundamental object lesson to be learned here if that happens. Anyone who dismisses it is no one I care to follow.

Yeah, you'll see some results trending in a positive direction when peaceable people can protect themselves. But I wouldn't expect any miracles, as a good part of the violence is taking place among a population that won't see its prohibited status affected one way or another. And McDonald won't do a thing as far as legalized carry is concerned:

At issue are Chicago’s laws (1) banning the registration of handguns, thus effecting a broad handgun ban; (2) requiring that guns be registered prior to their acquisition by Chicago residents, which is not always feasible; (3) mandating that guns be re-registered on an annual basis, including the payment of what amounts to an annual tax on the exercise of Second Amendment rights; and (4) rendering any gun permanently nonregisterable if its registration lapses.

A Phoenix police officer who mistakenly shot an armed homeowner during a search for an intruder was cleared of wrongdoing this week by a committee that reviews such shootings. [More]

Let's review:

Citizen's home is invaded.

Citizen confronts intruder and holds him at bay, using a gun to deter violence. If he'd deployed with anything else--a kitchen knife, a fireplace poker, a Louisville Slugger--chance are there would have been blood.

There was anyway.

An "Only One" comes barging in with his gun blazing without knowing what the hell the situation is and f***s everything up, shooting the homeowner in the back.

All according to official protocol, mind you. He did nothing wrong.

I guess if that's the way they want things to go down, we must adjust our home defense protocols accordingly, to where no one uninvited under our roof gets out moving.

No one.

Pity--most of us were prepared to trust our judgment to determine situation-appropriate responses. Looks like our options have been blown away...

However, a terse e-mail statement from Jacksonville Undersheriff Frank Mackesy on Moskowitz’s program said the Sheriff’s Office doesn’t “encourage anyone to take the law into their own hands. Be aware of your surroundings and contact the police.” [More]

Get that? Self-defense = taking the law into your own hands according to "Only One" Mackesy, who is under no legal obligation to protect anyone.

During a bizarre hearing there yesterday, a Superior Court judge dismissed animal-cruelty charges against a Moorestown police officer accused of sticking his penis into the mouths of five calves in rural Southampton in 2006, claiming a grand jury couldn't infer whether the cows had been "tormented" or "puzzled" by the situation or even irritated that they'd been duped out of a meal.

"If the cow had the cognitive ability to form thought and speak, would it say, 'Where's the milk? I'm not getting any milk,' " Judge James J. Morley asked. [More]

I may have done a verbal slip assuming the bill would also ban someone from buying ammo out of state and bringing it in. A Polk County sheriff's detective cataloging evidence repeatedly put down her work and picked up a Wii remote to bowl. When she hit two strikes in a row, she raised her arms above her head, jumping and kicking.
