The Ratings Game

If you are an NRA member, you should consider contacting them and asking how a freedom hating militant like Burdick does not get an "F" and Gordon Smith who promised to vote to renew Bill Clinton's gun ban gets an "A-" Meanwhile, anti-gun Attorney General candidate John Kroger is unrated, and vocally pro-gun candidate Jim Leuenberger is ignored.

Some have been calling for reforms for years--only to be ignored.

But just because Fairfax doesn't want to address it doesn't mean we shouldn't stop pressing them. Their credibility is not the fault of those who want them to actually have some. We are not responsible for their reputation. They are.

And the institutionalized deal-making and arrogance seem to be getting worse, not better.

Who knows if the current series of events will be the ones that trigger a suspension of what was supposed to make America different. If not this disaster, we face others threats of equal if not greater danger. And many are but a meal or two away from no food and water.

The fact that martial law is being discussed in the Congress should give everyone pause--as much as we'd like to deny or at least ignore the unique dangers of our time.

As an aside, knowing what he knows, it's telling that Brad Sherman is a moron on guns. I remember some years back he was challenged by Babylon 5 actor, Jerry Doyle, who lost in a landslide. I emailed Doyle at the time asking his position on RKBA, and his support for it was too tepid and fraught with "reasonable restrictions" to warrant getting behind.

UPDATE: I'm told in "Comments" this refers to "Congressional Martial Law," basically a way to pass all kinds of stuff into law that our representatives won't have a chance to understand before voting. That seems just as dangerous--more insidious and something that will be said and done before "We the People" will even know what happened. That said, Sherman's claim was that "a few members were even told that there would be martial law in America [emphasis added] if we voted 'No.'" He did not say "congressional martial law."

As I originally asked: "Pre-election scare tactics?" Who knows?

It's incumbent on Mr. Sherman, who made the charge, to explain himself--including letting his constituents and the rest of us know who told him exactly what.

About the Palm Pistol...

We've talked about this before.

Regarding the single shot issue, I have been following many blog threads and this seems to be a common objection. I am aware of both the limitations and advantages to a single shot design as described in the specification document posted at http://www.palmpistol.com/. There are many single shot self defensive firearms and devices which have their place in the market such as pepper sprays, Derringers, etc. Most notably, Tasers, which are quite successful, are also single shot and not nearly as effective as a live cartridge.

The Palm Pistol is not for everyone. But firearm enthusiasts fail to appreciate there are many people, particularly seniors and disabled, who due to physical limitations or simple intimidation, would be unable to properly wield a traditional revolver or semi-automatic.

Also note I am applying for DME (Durable Medical Equipment) coding for the design since I believe this assistive device may qualify as such under CMS (Center for Medicare and Medicaid Services) regulations. If successful, it is possible some insurance companies many offer partial reimbursement for purchase if the insured is disabled. I don't expect Medicare to reimburse but anything is possible, particularly if an argument concerning ADA (Americans with Disabilities Act) compliance can be made. If a DME coding is issued, this will be the first in the nation that I am aware of and I would hope that people who believe in the RTKBA, for everyone including the disabled, should welcome and support my efforts.

All the so-called "experts" insisted the design would be classified as AOW and I proved them wrong. I have learned long ago to ignore the advice of experts if your own logic and research suggests otherwise.

While the majority is picking things apart, trying not to rock any boats, and throwing sand on the new, the innovators push forward despite the catcalls, bringing progress to us all through revolutionary ways of thinking.

And they're not content to just contradict themselves--they need to throw out insults about the "wild, wild West" and "big, bad macho men," just so there's no mistaking the contempt they feel for their constituents. But my favorite attitude comes from funeral director(!) Paul R. Riddick, who thinks it's "ridiculous" for anyone who's not an "Only One" to openly carry, and stormed out in a fit of pique, hands on ears chanting "Lalala" rather than listen to citizens petition for recognition of their rights because "he didn't want to dignify the group by staying."

I'd say the dignity of the proceedings went up considerably after you were no longer there, obnoxious tyrant wannabe, but you're missing the point. You're not being asked to recognize rights, you're being told. You seem to have yourself confused with someone who's calling the shots in this, pun intended, and you're hardly showing the proper level of respect to those who are. And was that crack about Bob's Gun Shop an implied threat to chill future peaceful assembly for redress, or just another calculated insult against the character of VA gun owners?

Thes ingrates don't realize the citizens were doing them a favor.

VCDL is doing a hell of a job here, and are giving the rest of us a template to follow--if gun owners would just get off the dime and actually do something...

Well, the short story is that I found out my National Rifle Association dues were used to pay for a massive swiftboating ad campaign against Barack Obama regarding guns and shortly thereafter decided that I was not going to take it.

Tripped on your face right out of the starting gate. If you knew the first thing about what you're talking about, you'd know:

Neither NRA member dues nor contributions to ILA can be used directly for the election or defeat of candidates.

You're going to do the honorable thing and issue a retraction and apology now, right?

Roadside Survival Tips

If you run into one of these cops just comply with everything they tell you to do. Arguing with us on the side of the road will never get you anything and usually tends to escalate the situation even more. If you are treated heavy handed by a poorly trained cop just cooperate.

I guess that depends on how heavy handed and how poorly trained.

My recommendation is to initially be polite and respectful to every human being you meet--if they'll let you be. And try to defuse emotional confrontations by being as calm and rational as you can. In general, life just seems to work out better that way.

If you're pulled over, count on them having a wealth of information about you, including if you have a "permit," count on that information already having been recorded, and count on your attitude being the only one you can control.

NRA-PVF Endorses "A"-Rated Stupak

It's nice to see fences have been mended.

Time was, they only gave him a "C+."

That's probably because he supported the Brady positions on "campaign finance reform" First Amendment abridgements, not excepting RKBA political speech, not reducing background check time, private sale controls, opposing repeal of the DC gun ban and HR 2122.

But he's done good before and he's done good since, and we really ought to judge people by where they're at now, right?

I don't know how the group behind this, who are reportedly "spending well into the 'eight figures' -- some have estimated as much as $40 million," to defeat who they predict would be "the most anti-gun president in American history," can present such a glowing endorsement with a straight face--and expect any credibility when they do.

It's not like Republican opponent Tom Casperson suffers by comparison, but let's grant for a moment that supporting Stupak is the politically smart thing to do--the guy can be supportive of gun owners, the lobbyists can work with him, it give us another voice in the democrat party, we can't realistically expect him to jump ship on the party nominee and be effective--come up with all the valid reasons for people to choose Stupak that you will. Fine.

Make those arguments. Come up with the pragmatic reasons why it's in our interest to do the political thing.

But address the differences, too, so we can be fully informed, evaluate the good with the bad, and persuade based on information we deserve to know, so that we can weigh best perceived outcomes against principles. In other words, cut the BS and be honest--why is that too much to expect from our "gun rights leaders"? This business of treating gun-owning voters like slogan-thirsty idiots who only serve to drink the Kool-Aid and pay for the next round does not serve well to inspire confidence in the sincerity of the Fairfax spin machine.

A Sportsman We Can Believe!

If you are an avid hunter and target shooter like me, you should be relieved to know that neither presidential candidate wants to take away your right to enjoy your sport.

Growing the Democrat Base

Virginia Gov. Tim Kaine has granted voting rights to nearly 1,500 felons this year, bumping up the voter rolls ahead of next month's presidential election and putting himself on pace to exceed the record-setting pattern of his predecessor.

I'm not changing my long-held position that whoever can't be trusted with a gun can't be trusted without a custodian, I'm just observing a reality that I've never seen properly exploited: I'd like to see someone take a valid survey of maximum security prisoners for their preferred political affiliation and candidates.

SAF Files Amicus Brief in Nordyke

Arguing that the Supreme Court opened the door toward incorporation of the Second Amendment in its landmark ruling in the Heller case, the Second Amendment Foundation (SAF) has filed an amicus brief in the long-running case of Nordyke v. King, a challenge to the gun show ban in California's Alameda County.

This is worth supporting. The implications could be huge.

We're the Only Ones Keeping Work and Home Separated Enough

A town police officer arrested in New Milford last week and charged in connection with a domestic violence complaint was scheduled to return to work today...

Almeida appeared Monday in Superior Court in Bantam, where a judge ordered him to surrender his service revolver at the end of each shift while the case is pending.

Because being a stressed "Only One," it's not like he could do any damage on the job. Unlike you and me, who could never be trusted under such a cloud.

I also emailed his department and asked if they still issue revolvers--or if the "Authorized Journalist" might instead be a tad subject matter-challenged. I'll report if they reply.

Not surprisingly, when you consider the Chicago political establishment, anti-gun Mayor Richard Daley, who never saw a private citizen’s gun he didn’t want to ban, supports Mell’s proposal. Apparently Mr. Daley’s theory is, the only ones who can be trusted with firearms in Chicago are members of law enforcement, his personal security detail, and fellow politicians — at least ones he’s allied with.

The first article I read in the June issue was "The Sullivan Law...Makes Crime Safe." The more I read, the madder I got. That Sullivan Law should have been thrown out a good many years ago. How come the sportsmen don't do something about it?...
I know I would hate to have a law like that in Connecticut; and we could have had a law like that in 1958 if the 24 bills against firearms then submitted had been made into laws. But the sportsmen got together in strength and opposed these bills before a hearing in Hartford. It is always easier to kill a bill than to fight a law.

Some gun owners were aware and active 50 years ago. Too bad more weren't.

Acquittal/Deadlock in Friesen Case

The jurors informed the Honorable Judge Leonard that they acquitted Mr. Friesen on the single charge of lying about the safe in his office but they were hopelessly deadlocked on on the remaining charges, apparently, 7 to 5...This means that the Government can decided to re-try the case, minus the lying about the safe in his office charge, or allow the mistrial to stand.

The case is US v. Friesen. I touched on it here, specifically the expert conclusion on NFRTR unreliability for criminal prosecutions.

Len Savage was retained as an expert witness in this case. Naturally he cannot reveal any privileged information he had access to, but we should be able to get some good insights as details are made public. And naturally, WarOnGuns will post more as it becomes available.

Hamilton County Sheriff Doug Carter said he regrets his decision to release a former Indianapolis Police Department detective jailed as a suspected drunken driver...

Carter said the policy allowing him to release an inmate without a judge's authorization exists because such releases are necessary under certain circumstances.

What circumstances?

He said the full police authority wielded by reservists can be valuable to retired professionals, who join the reserves to maintain those powers and be eligible for higher wages in security jobs.

Sing for Change!

I was going to link to the "Sing for Change" video, but I guess it's been taken down because it creeped too many people out. If you didn't get a chance to see it, it was a bunch of kids from Venice CA singing the praises of The Lightworker under the direction of a grimacing Stepford-tranced music instructor, with approving adults beaming and others providing accompanying music. Plus it had some major Hollywood backing, which kind of makes the spontaneous grassroots support claim seem...ridiculous.

I wish the YouTube video hadn't been removed though, because there was a comment the teacher Kathy Sawada left there that just really exemplified the mutton-headed emotional mysticism that is the "liberal" Obama supporter--something along the lines of the children should be our leaders because they are innocent and don't know anything.

I also understand that the video also appeared at this link on Obama's website, which means someone there thought it would be a good idea.

The South Dakota Supreme Court on Monday heard arguments over whether yelling profanities at a passing police officer is protected speech under the U.S. Constitution.

I admit mixed feelings on this. "Fighting words" do exist. Some verbal abuse a man just shouldn't have to take.

That said, my primary concern is making sure "Only Ones" aren't getting a free pass to do to citizens what they will not tolerate happening to them.

No Authority

I find no specific statutory authority granting the Department the authority to prohibit the open carrying of firearms in state parks.

Damn straight. Now let's make sure they don't exceed their authority.

I do find this headline over the top, hyperbole-wise. The VA AG wasn't "standing up for the Second Amendment!" He didn't even mention it, except for one footnote, and focused instead on Commonwealth code.

Still, this shows how a definitive opinion from a state attorney general can have a very real and immediate practical impact on the conduct of enforcer agencies. And just to clarify what I proposed for Ohio open carry yesterday: Don't for a minute think there's a sheriff, chief or cop in the state who doesn't already know the law in this regard. My aim was to take that excuse away from them, once and for all.

Questioning the Mission

Months ago I wrote a letter to the editor of this newspaper. As a result, Federal Agent Thomas Chittum asked to move the trial of my friends Leonard and Tom Elliott to Frankfort and cited my letter as cause, claiming I had “polluted the jury pool.” I was named specifically before the court and was criticized for questioning both the mission of his agency, the Bureau of Alcohol, Tobacco, Firearms & Explosives, and in particular his case against the Bacon Creek Gun Shop. I didn’t realize I was such an influential scribe.

More chilling of public oversight and criticism from our pals the feds--it seems to be one of the few standardized and uniformly applied procedures they have.

A Plan to Stop Cops from Harassing Openly Carrying Gun Owners in Ohio

Get on the ground, an officer ordered, forcing the surprised group to set aside their drinks and hit the sidewalk belly-down. An officer began searching one of Llewellyn's friends before abruptly ending the suspense and demanding to know who had the gun. [More]

We had this happen in Willowick a while back and it looks like Ohio cops still aren't getting the message--in spite of the chief notifying the Attorney General. Sure, she put out a booklet with a brief mention on page 18, but that's a far cry from positively ensuring that the law is understood by those tasked with enforcing it. Matter of fact, with the "If you openly carry, use caution" recommendation, that puts the burden solely on the citizen.

And that's the best our gun rights leaders have given us, too :

State law does not prohibit the open carrying of firearms except in certain locations, but a person should exercise caution when carrying a firearm in public.

As we've repeatedly seen, one can exercise all the caution in the world and still end up on the floor--or worse. That's not good enough. Those who get paid to enforce the law have a responsibility to know just what it is they can and cannot enforce in this regard--especially since it creates the potential for a lethal encounter.

They don't have a right to put us at risk like that. It needs to stop. Starting today.

What follow is a rough draft of sorts on how this could be done. Thing is, I won't be the one doing it. My plate is already full. Which means it probably won't be.

But I'd start out with a letter to the AG, return receipt requested, putting her on notice with something along these lines:

This creates a dangerous and intolerable risk for citizens and a not undeserved liability for Ohio law enforcement agencies.

It is incumbent on you as the highest law enforcement executive in the state to rectify this, especially since you cannot claim you're not aware that risks exist. I am prepared to spearhead a project to try to notify every police chief and sheriff in the state via the enclosed return receipt letter.

But that's really not my job, that's yours. I'm calling on you to notify every police chief and sheriff in the state as to the legality of open firearm carry in Ohio. You have the resources and the staff to accomplish this with just one order. And law enforcement heads will heed you--with me, there's no such guarantee.

Consider this your notice that dangerous deficiencies exist within Ohio law enforcement as to the proper understanding and application of state law. Should you now fail to act on this, and should any citizen suffer any harm as a result of your lack and/or thoroughness of action, a copy of this letter and the USPS return receipt will serve as documentation that you were notified of your obligation and, with negligence and/or deliberate indifference, did not fulfill it.

Enclosure

The enclosure form letter she'd get a copy of follows. This is something that would need to be sent to every LEO head in the state--by return receipt mail in order to create a documented record that they have received notice. As such, whoever took on this project would probably need to raise a thousand dollars or so for postage, plus have the time and resources to customize each letter with the appropriate chief/sheriff, department and address, and go to the post office to fill out the return receipt forms and mail them. Here's where you'd get that information from (and these may need to be verified as current and complete).

The legal burden of proving innocence should not fall on citizens exercising rights over which your department has no legal authority. This creates a dangerous situation. It is up to your officers to know what laws they have authority to enforce, and not to attempt enforcement activity for which they have no legal authority. It is your responsibility to ensure they are properly trained in this regard.

I think it's not a bad little project, and something a team of volunteers could do it in very little time and for very little effort and expense--a bang for the buck kind of effort. I'd think each county should have someone who takes charge and assumes responsibility for getting it done in that area. Larger counties would need a couple of volunteers.

If I had one dedicated week and the postage, I could do the whole job myself. But, like I said, I'm already more than occupied.
If enough Ohio volunteers contact me, I'll put you in touch with each other and offer general help, but I'm not prepared to solicit funds and administer a project. I'd really prefer to see some grassroots gun group take this on and make it their own. And the thing is, it could also be emulated in other states that have similar open carry issues.

Any bets on whether or not this will just turn out to be a[nother] theoretical exercise in what might have been?

Challenging BS

This year, her Republican opponent, Mineola Village Mayor Jack Martins, is promising to make McCarthy's long tenure in Congress - rather than her newness - the main issue in the campaign. With a well-funded campaign, Martins may prove McCarthy's most serious challenge in years.

What, old BS (Barrel Shroud) McCarthy has some competition?

Thing is, I looked at this guy Martins' campaign site and elsewhere on the web. I can't find anything that suggests he gives a damn about RKBA.

Anybody know different? Or are the Republicans giving us more BS of their own?

Essential Standards

The Police Department here shut down its crime laboratory on Thursday after an audit uncovered serious errors in numerous cases. The audit said sloppy work had probably resulted in wrongful convictions, and officials expect a wave of appeals in cases that the laboratory processed...

The inspection found that the laboratory’s firearms unit was in compliance with just 42 percent of “essential standards"...

One word: Detroit.

The areas in this country with the heaviest government influence and controls are so screwed up. Why on earth would anyone propose more of it for us all as the solution?

Tacking on gun charges for those who face murder, robbery and assault charges may strike some as overkill. It's not.

I'd say that depends.

If the gun allows me to victimize more people, punish me for that.

But like "hate crimes," whether I kill you because you're black or white, or with a brick or a gun, you're going to be just as dead.

And what may seem like self defense in your eyes may be portrayed to a jury as an assault or murder.

Mount Vernon to Stage Flash Points

Police will begin staging gun checkpoints at the city's borders tonight as a way to curb violence in the city, officials said yesterday...

Lingering Questions

New York's 7-year-old database of handgun "fingerprints" has yet to lead to a criminal prosecution, and questions linger about its effectiveness. Still, state police remain committed to the database, saying more time and a long-awaited link to a federal ballistics database could bring success.

I have no lingering questions. The thing's a damned boondoggle, but one politicians find gives them cover for "doing something."

The only lingering questions the "committed" cops have are:What, are you NUTS? Why would we get rid of this sweet funding scam?

The excuses they're giving now ought to play for a couple more years, assuming the economy doesn't totally blow out. And if it does, I imagine police funding will be a priority anyway.

It's time for people to snitch on criminals instead of protecting viscous animals that prey on law-abiding citizens...

Sure thugs are committing crimes with firearms, but if it was tougher to purchase a weapon, maybe these animals wouldn't be able to acquire a gun as easily as buying a pack of gum...

Prior to the officers arriving, police say the suspect forced his way into the victim's home. The victim attempted to evade the suspect by retreating into a bedroom. The suspect followed her and she fatally shot him.

Too bad the Brady Campaign's "home rule" (you know, the one where the government rules your home?) wasn't in effect--then she might be dead.
